Welcome

Dear User, welcome to JOLZT! Please read these Terms and Conditions of Use (hereinafter referred to as 'Terms and Conditions') and pre-contractual information carefully before you start using the JOLZT platform.

By using the platform, you agree to these Terms and Conditions, confirming that you have read, understood, and accepted these terms and conditions, as well as all the terms, conditions, policies, and other documents attached as links in these Terms and Conditions.

Each time you access the platform, we will consider that you agree with these terms and conditions. If you do not agree with these Terms and Conditions, you do not have the right to receive further information or continue using JOLZT.

Changes and Amendments

JOLZT reserves the right to modify the terms and conditions and other policies and rules at any time at its discretion. If we modify these Terms and Conditions, we will post the changes. We will also update the 'Last Modified' date at the top of these terms and conditions.

If you continue to access or use the platform after we post the change or notify you of the change, you confirm with each further use of the platform that you agree to be bound by the amended terms and conditions. If the amended terms and conditions are not acceptable to you, your only option is to stop using and accessing the platform and to close (deactivate) your JOLZT user profile within 30 days.

INTRODUCTION

These Terms and Conditions regulate and define the process of using the tools, capabilities, and benefits offered by JOLZT DOO Skopje with EMBS 7760957 (in this text: 'JOLZT') on its website and/or application and/or other media of JOLZT (collectively 'JOLZT Platform', 'Platform JOLZT' or simply 'Platform').

When used in these Terms and Conditions, 'JOLZT', 'we', 'us' or 'our' refers to the entity – the legal entity JOLZT DOO Skopje with which you enter into a contract and commit to respecting these Terms and Conditions as well as all other terms, conditions, and policies of JOLZT.

JOLZT provides an online platform that connects platform users ('Members') and enables them to post, offer, search, and book rental and use services of passenger motor vehicles (in this text: 'Vehicles') under lease. Members who post and offer services are 'Clients' or 'Hosts', and members who search, book, or use services are 'Guests' or 'Users'.

JOLZT does not own, control, offer, or manage any listings, client services, or transportation services. JOLZT is not a party to the agreements made directly between Clients and Users, nor does JOLZT act as a travel agency, taxi company, transportation company, rental car company, insurance company, or organizer or seller of transport services and packages.

Age Restriction

Our platform is not intended to attract users who are under 18 years of age. These individuals are not allowed to use the platform under any circumstances.

Member Responsibilities

JOLZT does not recommend or endorse any member or any vehicle. Members are bound by these Terms and Conditions to provide accurate information. Although JOLZT may provide certain verification processes or conduct background checks, we do not provide any guarantees regarding the posted data of members, the behavior, identity, or suitability of any member, or the quality, condition, legality, or correctness of any vehicle.

Related Policies

JOLZT provides, respects, and uses other terms, conditions, and policies such as our Privacy Policy which describes our collection and use of personal data, our Payment Terms which govern all payment services provided to members, and our Cookie Policy which governs the use of 'cookies' we use that enable our platform to function and help us understand which information and ads are most useful to members, as well as all other policies, rules, and terms of JOLZT that help us and you to achieve greater satisfaction, safety, and protection when using the platform.

Right to Use the Platform

The right to use JOLZT is granted to individuals who are at least 18 years old. Any access to or use of JOLZT by any person under 18 years of age is expressly prohibited.

By accessing or using JOLZT, you guarantee and declare under full moral, material, and criminal responsibility that you are 18 or older, that you have the legal capacity to enter into a contract and be bound by these Terms and Conditions, and that you are familiar with the specific rights, obligations, and conditions provided by the Road Traffic Safety Act and the Vehicle Act, as well as all other applicable legal regulations.

We note that the attached regulations are for informational purposes only and we do not assume any responsibility if they are amended, supplemented, canceled, or replaced by another regulation at the time of agreeing to these Terms and Conditions.

User Profile

Registration

To access the JOLZT platform and all its functions and benefits, you need to register and create a user profile and become a member of JOLZT. Registration of a user profile is done directly on the JOLZT Platform in accordance with the Terms and Conditions of registration.

To register your user profile, you need to provide accurate, up-to-date, and complete information during the registration process and update such information as needed.

During the registration process as a Client / Host, you provide us with data and documents such as: name and surname, residential address, date of birth, email, mobile phone number, information about your vehicle, and creating a password or connecting through a third-party service profile (including but not limited to: Apple, Facebook, and Google).

During the registration process as a User, you provide us with data and documents such as: name and surname, residential address, date of birth, email, mobile phone number, valid driver's license, and creating a password or connecting through a third-party service profile (including but not limited to: Apple, Facebook, and Google).

For your safety and compliance with all JOLZT rules, conditions, and policies, as well as applicable legal regulations, we reserve the right to request additional data and documents during the registration and verification process, as well as during the use of the platform.

Verification

Upon receiving a registration request on the Platform, the JOLZT team verifies your user profile, i.e., determines whether you meet the registration rules and conditions.

JOLZT reserves the right to refuse the registration of your profile if it determines that:

  • You use more than 1 (one) user profile;
  • Any information provided during the registration process or thereafter is found to be inaccurate, fraudulent, incomplete, outdated, or otherwise in violation of these Terms and Conditions, all other policies, rules, and conditions of JOLZT, as well as applicable legal regulations.

Cancellation/Suspension

JOLZT reserves the right to suspend or cancel your user profile if:

  • You create more than 1 (one) user profile;
  • It is determined that any information provided during the registration process or thereafter is found to be inaccurate, fraudulent, incomplete, outdated, or otherwise in violation of these Terms and Conditions, all other policies, rules, and conditions of JOLZT, as well as applicable legal regulations.

Personal Data

Your privacy is important to us. We, together with our team, assure you that we fully comply with applicable legal regulations for the protection of personal data and strive to ensure the highest level of protection of your privacy and your personal data.

Please review our Privacy Policy to understand how we collect, use, and protect your personal data. By using the JOLZT platform, you agree to the collection and use of your data as outlined in the Privacy Policy.

Rules for Clients

As a Client, you are fully responsible for the proper use and access to your profile and other content on the Platform in accordance with applicable laws, as well as the principles of good faith, morality, generally accepted customs, and public order and peace. By using the Platform, you commit to strictly adhere to these Terms and Conditions.

As a Client, you are fully responsible for accurately entering your individual usernames and passwords, which must be non-transferable and sufficiently complex to avoid using the same usernames and passwords as on other platforms, in order to protect your profile from fraudulent use by third parties or any other form of damage. In addition, it is prohibited to interfere with the normal use or utilization of the Platform on behalf of other Clients and/or Users.

As a Client on JOLZT, you can create posts, i.e., advertisements for the lease of your vehicle(s). To create an advertisement, you will be asked various questions about the Vehicle, including, but not limited to, location, capacity, size, features, availability, prices, and related rules and financial conditions.

With each publication of your advertisements, you guarantee and declare that each advertisement you create and the reservation or use of the vehicle in the advertisement you create (a) will not violate any agreement you have made with any third parties, and (b) will comply with all applicable laws, tax regulations, and rules and regulations that may apply to any vehicle included in the advertisement you create.

When you confirm a reservation request or receive a reservation confirmation from JOLZT, you as the Client enter into a contractual relationship (lease) directly with the User as the lessee and commit to providing the service in accordance with these Terms and Conditions, other rules, conditions, and policies of JOLZT, as well as all applicable legal regulations.

All terms you include in any additional agreement with Users must: (a) comply with these Terms and Conditions, all other policies, rules, and conditions of JOLZT, as well as applicable legal regulations, and (b) be made available in the advertisement description.

Your relationship with JOLZT is that of an independent individual or entity, not an employee, collaborator, agent, or partner of JOLZT, except that JOLZT acts as a collection intermediary as described in the payment terms. JOLZT does not direct or control your offering, and you understand that you have full discretion whether and when to provide your offering, at what price, and under what conditions.

Responsibility for (not) knowing and (not) following all laws, regulations, and rules related to your listing lies with you. All legal information we provide is for informational purposes only, and you should independently confirm your legal rights and obligations.

We point out that if you are a Client and act on behalf of a legal entity or any other entity which may be considered a legal person, you are still responsible as a Client in accordance with these Terms and Conditions, other rules, conditions, and policies of JOLZT, as well as applicable legal regulations.

If you are a Client and a reservation for your vehicle is requested through JOLZT, you will be obligated either to confirm or to reject the reservation within the reservation period, which is ---- hours. Otherwise, the requested reservation will automatically expire, and the vehicle will not be reserved.

As a Client, you do not have the right to cancel a User's reservation without a real and justified reason in accordance with applicable rules, conditions, policies, and regulations. JOLZT reserves the right to impose additional charges and fees, as well as cancel/suspend your user profile if it notices a cancellation of a reservation without a real and justified reason.

Any changes and modifications to your listings and reservations are allowed, with the potential consequence that JOLZT has the right to impose additional charges related to the reservation modification.

As a Client on the platform, you confirm that you are aware of the tax obligations imposed by the tax regulations of the Republic of North Macedonia and that JOLZT has no obligation to calculate and pay any taxes and fees for the income you earn as a Client for renting your own vehicle.

Our general recommendations for you as a Client are as follows:

  • Accuracy of information: Provide accurate, up-to-date, and complete information about your vehicle.
  • Safety and maintenance: Ensure that your vehicle is in good condition, regularly maintained, and safe for use.
  • Hygiene: Provide a clean and hygienic vehicle for your Users as Renters.
  • Appropriate documents: Ensure that all necessary documents are up-to-date and available.
  • Usage rules: Clearly state all the rules and restrictions for using your vehicle.
  • Respecting reservations: Honor all confirmed reservations.
  • Responding to reports: Respond to reports of damage or issues from Users promptly.

By advertising and renting your vehicle, in accordance with applicable legal regulations, you confirm and commit to the following:

  • The vehicle you advertise and rent is properly, timely, and legally registered.
  • The vehicle you advertise and rent has a valid traffic permit.
  • The vehicle you advertise is exclusively your property and/or you have the right to rent it.
  • You will not violate any third party's rights by advertising and renting the subject vehicle.
  • You have valid compulsory liability insurance for the period of renting your vehicle.
  • You will not advertise and rent the vehicle for the purpose of taking it outside the borders without proper authorization.
  • You will not advertise and rent a vehicle whose engine power exceeds 77 kilowatts to a beginner driver.
  • You will not rent to a person who does not have the right to operate a motor vehicle.
  • You will fully comply with the Road Traffic Safety Act and the Vehicle Act.

Rules for Users

As a User, you are fully responsible for the proper use and access to your profile and other content on the Platform in accordance with applicable law, as well as principles of good faith, morals, generally accepted customs, and public order.

As a User, you are entirely responsible for correctly entering your individual usernames and passwords, which must be non-transferable and sufficiently complex so that the same usernames and passwords are not used on other platforms.

On the platform, you can search for Client listings by type of Vehicle, vehicle performance, rental period and dates, and similar. For more precise searching, the platform offers filtering of your preferences ('Filters').

By selecting the desired option (listing), you send a reservation request to the Client, agreeing to pay all costs and fees, including, but not limited to, vehicle rental fees and other related costs.

When you receive a reservation confirmation from JOLZT, you as a User enter into a Rental Agreement (Lease) directly with the Client as the Lessor and commit to comply with these Rules and conditions, other JOLZT rules, terms, and policies, as well as all applicable legal regulations.

Your relationship with JOLZT is that of an independent individual or entity, not that of an employee, collaborator, agent, or partner of JOLZT, except that JOLZT acts as a collection agent as described in the Payment Terms.

As a User, you are solely and exclusively responsible for returning the Vehicle in the condition in which it was handed over to you at the time of delivery. As a User, you expressly confirm and agree that you are solely responsible for your own actions and any omissions, as well as the actions and omissions of any third parties to whom you have allowed access to the vehicle.

If, as a User, you cancel your reservation before the requested reservation is confirmed by the Client, JOLZT will cancel any pre-authorization from your payment method and/or refund any nominal amounts charged to your payment method in connection with the requested reservation within a reasonable time.

By making reservations and using a rented vehicle, in accordance with applicable legal regulations, you confirm and commit to the following:

  • You have a valid driver's license issued in the Republic of North Macedonia, a foreign driver's license, or an international driver's license.
  • Your driver's license does not have a restriction for operating a motor vehicle with an automatic transmission (if applicable).
  • You have not been issued a penalty for the cessation of the validity of the driver's license or a ban on operating a motor vehicle.
  • The validity period of your driver's license has not expired.
  • You will not use the vehicle if you are so tired or ill or in such a mental state that makes you incapable of safely operating the vehicle.
  • You will not use the vehicle under the influence of medications that are marked as not to be used before or during driving.
  • You will not operate the vehicle under the influence of narcotic drugs or psychotropic substances.
  • You will not operate the vehicle under the influence of alcohol.
  • You will not operate the vehicle if you are a novice driver during restricted hours without proper accompaniment.
  • You will not operate the vehicle outside the borders without proper authorization.
  • You will fully comply with the traffic rules established by the Road Traffic Safety Act.

Rental Agreement

By initiating and confirming a reservation through JOLZT, the Client and the User agree and confirm that they are entering into a legal-binding relationship, namely a Rental Agreement. The terms and conditions stated in the listing, including all details about the vehicle, prices, and rules, are an integral part of this rental agreement.

Both parties are permitted to formally conclude a rental agreement, as well as to enter into additional agreements or annexes to further regulate or resolve any specific needs or circumstances, provided they do not contradict the basic terms of the listing, these rules and conditions, other rules, conditions, and policies of JOLZT, as well as applicable positive regulations.

JOLZT is not responsible for the obligations arising from the concluded Rental Agreement between the User and the Client. Under no circumstances can JOLZT be held liable for obligations related to the payment of fees/rental, the handover of the vehicle into possession, liability for damage caused to the vehicle and/or other items and third parties, as well as for subleasing the vehicle.

Taxes

By agreeing to these terms and conditions and subsequently listing vehicles and making vehicle reservations, members understand and agree that they are solely responsible for their tax obligations. JOLZT cannot and does not offer tax advice to any member.

Prohibited Activities

By joining JOLZT and using the platform, you confirm that you are solely responsible for compliance with applicable laws, other rules, regulations, and tax obligations that may apply to your use of JOLZT. In connection with your use of JOLZT, you agree that you will not, nor will you allow any third party to:

  • Violate or circumvent these Terms and Conditions or applicable laws.
  • Use JOLZT for any commercial or other purposes not expressly permitted.
  • Copy, store, or otherwise access or use any information about other members improperly.
  • Use JOLZT in connection with the distribution of unsolicited commercial messages ('spam').
  • Advertise a vehicle that you do not own or do not have permission to rent.
  • Use JOLZT to search for, make, or accept a reservation outside of the JOLZT platform.
  • Request, accept, or make any payment for listing and reservation outside of the JOLZT platform.
  • Discriminate or harass based on race, national origin, religion, gender, etc.
  • Use, display, copy the JOLZT platform or any of its elements without express written consent.
  • Disrupt the brand and reputation of JOLZT.
  • Use any automated means to access or collect data from the platform.
  • Circumvent any technological measure implemented to protect the platform.
  • Attempt to reverse engineer any software used to provide the platform.
  • Take any action that damages or adversely affects the platform.

Cancellation and Suspension of User Account

JOLZT may, at its discretion and without liability to you, where applicable under these Terms and Conditions, other rules, conditions, and policies of JOLZT, as well as all applicable laws, with or without prior notice and at any time, decide to restrict, suspend, deactivate, or cancel your user account.

In such a case, you may face some or all of the following consequences:

  • Your user account will be deactivated or suspended.
  • Any future reservations will be immediately terminated.
  • Notification to your Users or Clients that reservations are canceled.
  • Refunds to your Users for all confirmed reservations.
  • As a Client, you will not be entitled to any compensation for canceled reservations.

Limitation of Liability

By using the JOLZT platform or collective content, you acknowledge that you are doing so fully informed and at your own responsibility and risk. You also acknowledge and agree that JOLZT has no obligation to conduct checks on the status and background of any member.

JOLZT does not guarantee that the JOLZT Platform, including but not limited to listings or any vehicles, will meet your requirements. JOLZT does not guarantee the quality of any listings, vehicles, clients, users, nor the accuracy, truthfulness, completeness, or reliability of any collective content available on the JOLZT Platform.

Neither JOLZT nor any other party involved in creating, producing, or maintaining JOLZT will be responsible for any incidental, special, or consequential damages (material or immaterial).

Dispute Resolution

In terms of the interpretation and application of these Terms and Conditions, the law of the Republic of North Macedonia applies. In the event of a dispute regarding the use of JOLZT and the application of these Terms and Conditions as well as all other rules, conditions, and policies of JOLZT, the competent court in Skopje, Republic of North Macedonia, will have jurisdiction for its resolution.
